You could try, but I suspect you might attract unwaned attention from the FAA, CIA, FBI and the military. Pinging unsuspecting aircraft with a sufficiently strong laser is likely to result in people assuming that you're using a laser ranging or targeting system, and therefore a terrorist. That and any "misses" that stray into the cockpit would constitute a federal offence.
The theory is sound, but I wouldn't try and put it into practice yourself unless you want to be rudely awakened at some ungodly hour of the morning by a SWAT team, knocking on your door with a battering ram or a shaped charge.
